1. Agreement to Terms

By accessing and using the EcoPath Hiking website and services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity, and EcoPath Hiking, concerning your access to and use of our hiking tour services, website, and any related services.

2. Booking and Reservations

All bookings are subject to availability and confirmation by EcoPath Hiking. A booking is only confirmed once you receive written confirmation from us via email. Payment in full or a deposit (as specified) is required to secure your reservation.

We reserve the right to refuse service to anyone for any reason at any time. Prices are subject to change without notice, but confirmed bookings will honor the price at the time of booking.

Group bookings of 6 or more participants may be subject to special terms and conditions, which will be communicated at the time of booking.

3. Cancellation and Refund Policy

Cancellations made more than 14 days before the scheduled tour date will receive a full refund minus a 10% administrative fee. Cancellations made 7-14 days before the tour will receive a 50% refund. Cancellations made less than 7 days before the tour are non-refundable.

In the event that EcoPath Hiking must cancel a tour due to weather conditions, safety concerns, or insufficient bookings, participants will receive a full refund or the option to reschedule to an alternative date.

We strongly recommend purchasing travel insurance to cover unforeseen circumstances that may prevent you from attending your booked tour.

4. Participant Responsibilities

Participants must be in reasonable physical condition suitable for hiking activities. You are responsible for disclosing any medical conditions, physical limitations, or disabilities that may affect your ability to participate safely in our tours.

All participants must follow the instructions of guides at all times. Failure to comply may result in removal from the tour without refund. Participants are responsible for their own personal belongings and equipment.

You agree to respect the natural environment, follow Leave No Trace principles, and adhere to all park regulations and conservation guidelines during the tour.

5. Liability and Risk Acknowledgment

Hiking in wilderness areas involves inherent risks including but not limited to: uneven terrain, wildlife encounters, weather changes, and physical exertion. By participating in EcoPath Hiking tours, you acknowledge and accept these risks.

EcoPath Hiking, its employees, guides, and partners are not liable for any injury, loss, damage, or delay that may occur during tours, except where such liability cannot be excluded by law.

All participants will be required to sign a liability waiver before participating in any tour. Minors must have waivers signed by a parent or legal guardian.

6. Photography and Media Use

During tours, our guides may take photographs and videos for promotional purposes. By participating in our tours, you grant EcoPath Hiking permission to use images and videos featuring you in our marketing materials, website, and social media.

If you do not wish to be photographed or have your image used, please inform your guide at the beginning of the tour. We will respect your privacy preferences.

7. Intellectual Property

The content on the EcoPath Hiking website, including text, graphics, logos, images, and research publications, is the property of EcoPath Hiking and is protected by Australian and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works from any content on our website without express written permission from EcoPath Hiking.

8. Privacy and Data Protection

Your personal information is handled in accordance with our Privacy Policy. We collect and use personal data only for the purposes of providing our services, improving customer experience, and complying with legal requirements.

9. Changes to Tours and Itineraries

EcoPath Hiking reserves the right to modify tour itineraries, routes, or schedules due to weather conditions, safety concerns, conservation requirements, or other unforeseen circumstances. We will make reasonable efforts to provide comparable alternatives.

No refunds will be provided for minor itinerary changes, though significant changes that materially affect the tour experience may be eligible for partial refunds at our discretion.

10. Age Restrictions and Requirements

Some tours have minimum age requirements based on difficulty level and safety considerations. Parents and guardians are responsible for ensuring children meet these requirements and supervising minors throughout the tour.

Participants under 18 must be accompanied by a responsible adult. EcoPath Hiking reserves the right to refuse participation if we determine a participant does not meet the physical or age requirements for a specific tour.

11. Code of Conduct

All participants are expected to behave respectfully toward guides, other participants, and the natural environment. Harassment, discrimination, dangerous behavior, or intoxication will not be tolerated and may result in immediate removal from the tour without refund.

We maintain a zero-tolerance policy for littering, damage to flora and fauna, or violations of conservation regulations. Such behavior may result in legal consequences in addition to removal from the tour.

12. Force Majeure

EcoPath Hiking is not responsible for failure to perform services due to circumstances beyond our reasonable control, including natural disasters, extreme weather, government restrictions, pandemic-related closures, or other force majeure events.

In such cases, we will work with participants to reschedule tours or provide refunds as appropriate under the circumstances.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising from these terms or our services will be subject to the exclusive jurisdiction of the courts of Queensland.

By using our services, you consent to the jurisdiction and venue of such courts in connection with any legal action or proceeding.

14. Modifications to Terms

EcoPath Hiking reserves the right to modify these Terms of Service at any time. Updated terms will be posted on our website with a revised "Last Updated" date. Continued use of our services after changes constitutes acceptance of the modified terms.
